The Admin at the rumour forum has come up with this:

"I have emailed Dale Fischer's clerk (Paul Pierson), and I got this as a response

With regard to your inquiry, the plaintiffs have filed a Notice of
Dismissal and the matter is no longer at issue


It basically means, Axl has dropped the case. It will NOT be going to court

Good news I think"

I don't know how useful, welcome news from that board is, but there you are.

I hope it's true because the last thing we needed was lots of legal wranglings delaying more important stuff *cough* chinese democracy *cough*.

I hope it's true.  Sanctuary can then go back to 'plodding on' with the release of CD...

In all honesty, when the Buckethead news broke and then this leagal action, I thought we were all screwed. Things could have got very bad between GNR and Geffen.

Hopefully, with rumours that Buckethead left ages ago and it having been dealt with, and now the possibility that the law suit has been dropped, I'm feeling much more positive. I hope it's all true.

I think he saw that there was nothing they could do now.. Its already out.. No need to continue spending money on a lawsuit thats not going to change the outcome..

Even if there was a small chance to stop its release they took it...

Ill bet the Redhead will always remember this tho...

If it is being dropped, very good news for CD. Now may be the time to announce the release date. Wave of decent publicity with the good sales, and Rio coming up. Does someone have a link to the rumor forum-Funk daddy?

I hope this is true, there is no way Axl and co. could have won the case if GH was already pressed.  I think it's getting the GN'R name back out there to non-hardcore fans which in end result make better sales for Chinese Democracy.

Yeah this is good Axl droped the case about the GH album. I think Axl and the others waited alittle to long to file the case to try and stop the GH. Myabe Axl just wants to move on and get ready for CD to come out this year.

Could be Muther.....it could also be that they came to some sort of "agreement" with the label, and part of that "agreement" was to drop the suit.  It happens sometimes, especially when "settlement" would look bad for either party.  We can only hope!

Which part don't you understand:

"the plaintiffs have filed a Notice of Dismissal and the matter is no longer at issue"

You may be thinking about the move for a delay to the release which was denied. That wasn't the case, that was a preliminary hearing

Actually, I would suspect, considering we didn't hear otherwise, that the 3 parties were acting as one plantiff...so, yes, essentially all 3 would have had to agree to dismiss the case.
