Former ADLER'S APPETITE Members Claim Ownership Of Band's Name, Threaten Legal Action

Former ADLER'S APPETITE members Jizzy Pearl (vocals; RATT, LOVE/HATE), Keri Kelli (guitar; VINCE NEIL, SLASH'S SNAKEPIT) and Robbie Crane (bass; VINCE NEIL, RATT) have issued the following statement:

"Concerning the recent departure of members of ADLER'S APPETITE, Keri, Robbie and Jizzy would like to address the situation. The truth is none of the partners have quit ADLER'S APPETITE. In February of 2003 Keri Kelli and Ryan Johnson (former ADLER'S APPETITE manager) recruited each band member, Johnson later came up with the moniker 'ADLER'S APPETITE.' On October 19th, 2004 in the state of California, Jizzy Pearl, Keri Kelli, Robbie Crane & Steven Adler [ex-GUNS N' ROSES] entered into a signed and notarized partnership agreement as 'ADLER'S APPETITE,' legally binding them as equal partners. The partnership has sole ownership and control of the name 'ADLER'S APPETITE,' the EP Masters, the ADLER'S APPETITE website, DBA and all present and future interests from records, merchandise and/or touring under the 'ADLER'S APPETITE' name. The ADLER'S APPETITE name and logo are registered trademarks owned by the partnership and its four partners. In accordance with the partnership agreement, no one single member has the right or authority to hire or fire anyone without a majority vote from all four partners. Steven Adler has violated this agreement and is in jeopardy of losing his share of the partnership and his right to the ADLER'S APPETITE name. Booking agents, promoters, club owners, record companies, merchandisers and any and all hired players should be aware that a legal partnership and trademark exists and anyone reproducing the ADLER'S APPETITE trademarked name and/or logo, anyone entering into any business affairs as ADLER'S APPETITE without the express written consent of all four legal partners are subject to full legal action.

"Keri Kelli, Jizzy Pearl and Robbie Crane want to thank all the fans for their support and apologize for the confusion."

Even if it does sound stupid (which it does), Adler has signed an agreement with the other 4, and he violated it. That's how stupid it is...

I mean "Adler's Appetite" pretty much insinuates that it is Adler's band and I would have thought no-one else would share a claim. But on the other hand Jizzy, Keri and Robbie should just sign over the rights of the name to Adler, what the hell would they want with that name when there would be no Adler left? "Adler's Appetite now 100% Adler free."

I think the other members don't have any intentions on using the name in the future without Adler.  I think they feel used by Adler in a way and Adler went on an AXL EGO trip.  Adler is complainging about Jizzy not being a good singer when he knew how Jizzy sounded all the time.  Adler wants less known musicians who will do WHAT HE WANTS TO MAKE A SOLO RECORD WHERE HE IS THE ONLY STAR.  The other members worked hard up to this point, in there opinion, and they are not going to let Adler use them and take the name they all created.

What do they hope to get out of this - the millions of dollars of royalties for their non-existent ''album''?

Everyone is blaming it on Steven but I think there's more to the story. Robbie/Keri supposenly are responsible for ripping the people off with the EP and merchandise fiasco. Remember Keri saying how he fired the company who was responsible for it? Strange since Robbie and Keri always took care of the complete business aspect of AA..

This is Brent Muscat talking about the agreement:

I have to say I find this Adler?s Appetite debacle quite amusing. I have stayed quiet about my involvement with the band for quite some time.

The fact is we had a good thing going for a while and in my opinion it was ruined by greed. Most crimes and murders stem from greed. We had a record deal with Shrapnel that they blew purely over greed.

They chose to dissolve the partnership agreement to throw me out of the band. Some members were jealous of what I have accomplished in the music business in the past and felt that I did not need the project as much as others.

Personally, I don?t think it was a great business decision to get rid of me considering I sold more records then everyone in the band combined, excluding Steven. I for one never looked at the band as a meal ticket, it was just a fun gig playing Guns N Roses songs to make extra cash.

I believe the other members really thought this was their Velvet Revolver. The big difference is Velvet Revolver has Slash, Duff, and a good drummer who was in Guns N Roses and they had Steven who was kicked out of Guns N Roses and still shows why.

Eventually, the members realized their mistake and asked me to come back to play with them in Japan which I politely declined. To put it simply they fucked me out of a tour, a record and guaranteed money and now they are all crying because it happened to them. Karma is a bitch.

As for their stupid partnership agreement, I believe, Steven Adler?s mother has power of attorney. Unless his mother is in the room and signs the contract, any agreement the band has is not legally binding. In the long run it is not worth the paper it is printed on, unless you are collecting Steven Adler?s autograph or run out of toilet paper.

My advice to those guys is to move on. There are plenty of cover bands out there. Steven has the GnR cover band, Jizzy and Robbie have a Ratt cover band and isn?t Kerry in a new cover band just about every other week?

Lets not forget what Slash had to say about Adler?s Appetite after hearing them live:

?The only one who plays in a cover band is Steven Adler. He just brings old Guns N' Roses songs, under the name of Adler's Appetite - the poor guy?

We (Izzy and Slash) went to the show and listened to the whole set. With guys from various L.A.-bands, and that was really funny. If only because of the involuntary realization that Guns N' Roses must have been damn good - cause the covers simply sounded like shit?? Quote: Slash

I totally respect Brent and I tried to contact him after I found out he was out of AA, but he never got back to me, and now I know why.

Shit, this guy is a hero to my eyes. He recovered from cancer.

It's just a pitty for all the others, if all he says is true, which I have to say I believe it is...

this is all ridiculous.  Steven never shouldve agreed to sharing partnership for a band that has HIS name in the title, and he needs to just pay the bastards off for the rights to it, because they cant use it.

That's what I was thinking... I couldnt figure it out. But Brent Muscat cleared it up.  The guys thought it would be their Velvet Revolver - meaning success, money, fame, etc. So they want to hold on to it.

I'm starting to realize why Izzy Stradlin just makes his music without any fuss.  You can avoid this business and lawsuit shit over the NAME - of all things  confused

if they wanted to become like VR, they shouldn't have chosen Adler's Appetite as a name anyways! lol.
wouldn't have hurt to have at least 1 guy in the band who weren't from the 80s scene either.

I still think Suki Jones is a much better name than AA!

In the Metal Sludge-interview Steven Adler says that "Dude, I have the copyright to my name Adler?s Appetite, in my desk at home, okay. They don?t own jack shit!"

The band is touring using the name Adler's Appetite so I don't understand what the fuck is going on.
It seems unlikely those ex-members would be threatening S.Adler for the sheer fun of it...
So why is he able to continue using the name?
Either they have made a settlement and S.Adler just didn't mention it or something will happen.
